SERVICE AGREEMENT AND WAIVER – 085 BRAZILIAN JIU-JITSU ACADEMY

This Service Agreement is made and entered into by and between:

085 Brazilian Jiu-Jitsu, located at 6027 Wesley Grove Blvd, Suite 201, Welsey Chapel, FL, 33544  hereinafter referred to as the “ACADEMY”,

and:

CLAUSE 1 – PURPOSE

The purpose of this agreement is to provide the {name} with access to martial arts training services, specifically Brazilian Jiu-Jitsu, to be delivered at the ACADEMY’s premises by qualified instructors.

CLAUSE 2 – TERM

This agreement shall be valid for a period starting on the date of signup and will be automatically renewed unless either party expresses their intention not to renew.

CLAUSE 3 – ASSUMPTION OF RISK & LIABILITY WAIVER

{name} understands that martial arts training involves physical contact and the risk of injury. By signing this agreement, the {name} voluntarily assumes all risks and releases the ACADEMY, its instructors, staff, and affiliates from any and all liability for injuries or damages resulting from participation, except in cases of proven gross negligence or misconduct by the ACADEMY.

CLAUSE 4 – HEALTH STATUS

{name} declares that they are in good physical and mental health to engage in physically demanding activities. {name} agrees to inform the ACADEMY of any pre-existing medical conditions. The ACADEMY recommends a medical check-up before starting training.

CLAUSE 5 – CANCELLATION AND REFUND POLICY

1. Cancellation must be requested in writing at least 30 days in advance.

2. No refunds will be issued for monthly fees already paid, except in the following cases:

   • Death or medically certified permanent disability

   • Relocation to a different city or state (with proof)

3. The ACADEMY reserves the right to terminate this agreement for:

   • Unsportsmanlike or aggressive behavior

   • Non-payment for over 30 days

   • Violation of internal policies or rules

CLAUSE 6 – IMAGE RELEASE

The STUDENT grants the ACADEMY the right to use photos, videos, or other media containing their image or voice, captured during classes, events, or competitions, for promotional or institutional purposes on social media, websites, and marketing materials.

CLAUSE 7 – GOVERNING LAW AND JURISDICTION

Any disputes arising from this agreement shall be governed by the laws of the State of Florida, and the parties agree to submit to the exclusive jurisdiction of the courts located in Wesley Chapel, Florida, waiving any other venue, regardless of how privileged.
